An Ordinance Regulating Parking on Township Roads
WHEREAS, pursuant to Sections 11-208 and 11-209 of the Illinois Vehicle Code (625 ILCS 5/11-208, 5/11-209), local authorities with jurisdiction over highways under their control may regulate the stopping, standing, and parking of vehicles; and
WHEREAS Greenwood Township, a body politic and corporate, through its Township Board of Trustees, constitutes a "local authority" under the Illinois Vehicle Code with respect to roads under the jurisdiction and maintenance of the Greenwood Township Highway Commissioner; and
WHEREAS the Township Board finds that the unrestricted parking of vehicles on township roads interferes with snow removal, road maintenance, emergency vehicle access, and general traffic safety; and
WHEREAS it is in the best interests of the public health, safety, and welfare to prohibit parking on township roads, except in designated areas.
NOW, THEREFORE, BE IT ORDAINED by the Township Board of Trustees of Greenwood Township, McHenry County, Illinois, as follows:
Section 1. Definitions
For purposes of this Ordinance, the following definitions shall apply:
- "Township roads" means all public highways under the jurisdiction of the Greenwood Township Highway Commissioner pursuant to 605 ILCS 5/6-201 et seq.
- "Vehicle" has the meaning set forth in 625 ILCS 5/1-217.
Section 2. Parking Prohibition
- Parking of any motor vehicle/camping trailer and/or boat and trailer or other trailer and/or motor vehicle/trucks for more than 24 hours is prohibited on Greenwood Township Road District roads, streets or highways. The Greenwood Township Road District "Official List of Roads" is attached as Exhibit A and identifies all applicable roads, streets, highways. A map identifying each road is attached hereto as Exhibit B.
- Parking of any motor vehicle is prohibited on any Greenwood Township Road District road with a speed limit of 35 mph or greater.
- Parking of any motor vehicle, boat or boat and trailer, or other trailer, camping trailer, or recreational vehicle is prohibited on any Greenwood Township Road District roads from November 1 until April 1.
Section 3. Enforcement
- This Ordinance shall be enforced by the McHenry County Sheriff's Office, or other law enforcement officers having jurisdiction.
- Any vehicle found in violation of this Ordinance may be ticketed, towed, or impounded in accordance with the procedures and requirements of the Illinois Vehicle Code.
Section 4. Penalties
Any person violating the provisions of this Ordinance shall be subject to a fine of not less than $50.00 nor more than $500.00 for each offense. Each day a violation continues shall constitute a separate and distinct offense.
Section 5. Severability
If any section, paragraph, clause, or provision of this Ordinance shall be held invalid, the invalidity thereof shall not affect any of the remaining provisions of this Ordinance.
Section 6. Effective Date
This Ordinance shall be in full force and effect upon its passage, approval, and publication in pamphlet form as provided by law.
